These Terms and Conditions of Sale govern the conditions under which users access and order items from the Skål Boutique at www.skal.org, property of:

Users must fully accept the General Terms and Conditions of Sale during their purchase process. These Terms and Conditions of Sale will be included in a link in the order confirmation email so that they can be archived by users for reference whenever necessary.

CUSTOMERS

Only members of Skål International may make purchases in the Skål Boutique, and they must identify themselves with their password in the members-only area of the Skål International website.

PRICE AND PAYMENT METHODS

The prices of our items are displayed in euros and include all taxes.

When placing an order, the customer can freely choose his/her payment method for the Skål Boutique by means of the following payment systems:

Credit/Debit Card (VISA, MASTERCARD, MAESTRO)

Payment via a credit or debit card at www.skal.org is processed through a secure payment gateway powered by the financial institution that we work with.

If this payment method is chosen, Skål International does not collect or process any user data relating with users' credit card numbers. All data is processed directly by the financial institution, thus making the transaction more secure and confidential.

PayPal

Payments can be made quickly and securely via a PayPal account balance or by using a credit/debit card on PayPal. In this case, the user will be redirected to PayPal so that payment can be made easily and without sharing any financial information with us.

DELIVERY LOCATION

The order's delivery location is to be the address that the user lists on the order form when making his/her purchase.

SHIPPING AND DELIVERY TIMES

For orders totaling under €100, the user can choose during the checkout process if he/she wants the items to be sent via normal post or a courier service. For orders of larger amounts, shipping will be via a courier service.

Skål International guarantees that all orders will be processed and shipped within a maximum timeframe of 5 working days. Delivery times depend upon the postal service or the courier service used. International shipments may be delayed due to customs inspections that Skål International cannot be held liable for.

SHIPPING COSTS

Shipping costs vary depending upon the place of delivery, the weight of the order, and the shipping method chosen by the user. When users make an order, they are informed of the cost of shipping before the order is finalized.

Additional customs taxes are to be paid by the order's recipient. We have no control over these charges nor can we predict their amount. There is great variability in the customs policies of every country; therefore, users must contact their corresponding customs office for more information.

RETURNS AND RIGHT TO WITHDRAWAL OF AN ORDER

Returns

In the event that the item received is defective or has been damaged in transport, it can be returned by the purchaser and Skål International will assume the shipping costs associated with said return. Skål International will then re-send a similar item for free.

Verlust

In the event that a package is lost in the mail, Skål International will re-send a similar item for free.

Withdrawal

The purchaser may exercise his/her right to withdrawal the order within the maximum timeframe of (14) calendar days from the date the item is received.

The costs associated with the return when the user exercises his/her right to withdraw are to be covered by the purchaser.

Refunds of the purchase price are made once the state of the returned items has been verified, and refunds are made through the same payment method as was originally used to pay for the order. Under all circumstances, refunds will be made within a maximum timeframe of 14 calendar days from the time that Skål International receives the returned items.

The purchaser consents to allowing the value of the goods to be lowered if they have been handled in an improper way that does not align with their nature and characteristics. In this case, Skål International will analyze the state of the items being returned and, when applicable, inform the purchaser by reliable means that the product price will be lowered due to improper handling by the purchaser, always providing justification through objective, verifiable means.

The purchaser may exercise his/her right to withdrawal by sending an email to our email address, skal@skal.org.

This right to withdrawal will not be applicable to personalized products such as, for example, medals with inscriptions (Club name, etc.).

In the event that a customer has returned a product because of an alleged defect or error in the goods and it is later determined that said defect or error does not exist, the costs for the return will be charged to the customer.

CLAIMS

The customer is the sole party responsible for choosing the product purchased, as well as for how the product is used.

Skål is not to be held liable for losses and/or damages caused by defects in products included in the order unless an applicable law holds it expressly liable. All liability is to be limited to the amount of the order.

Customers cannot make a claim to Skål for any damages after a year, counted from the date the product is received, unless a mandatory law sets a higher period.

The customer will be the only party liable, thus exonerating Skål and holding it free and harmless against any third parties, in relationship with any liabilities stemming from damages and/or losses related with the improper or wrong use of the products purchased.

FORCE MAJEURE

Skål will not be held responsible for a failure to comply, or delay in compliance, with its obligations to the customer – provided said failure to comply or delay in compliance is caused by any reason of unforeseeable circumstances or force majeure affecting both Skål and its providers or carrier companies. This includes strikes, other labor or industrial contingencies, a lack or inability to secure raw materials, etc. If the cause of force majeure lasts for more than 2 months, Skål or the customer may void the product orders being processed, and in this case the customer has no right to indemnification or compensation.

APPLICABLE LAW AND JURISDICTION

The parties agree to turn to Spanish law to solve any conflicts that may arise in relationship with the Terms and Conditions stipulated herein, waiving their right to any other jurisdiction and agreeing to submit discrepancies to the courts of the user's address.
